John McNeil was called to the Bar of Ontario in 1972 and was appointed a Queen's Counsel in 1985. He has practised civil litigation in all levels of Courts, trial and appellate, including the Federal Court of Canada and the Supreme Court of Canada, at various administrative tribunals, and at arbitrations. His practice focuses on commercial and casualty insurance-related matters, involving all categories of liability disputes, including professional liability claims against accountants, lawyers, real estate brokers, insurance agents, engineers and surveyors, as well as personal injury litigation, cargo liability claims, freight claims and reinsurance arbitrations. His practice includes coverage opinions in matters of disputes under automobile, commercial liability, professional liability and directors and officers policies. His retainers have included representation in multi-year, multi-level coverage disputes. He has been retained to supply advice to underwriters in the drafting of insurance liability policies, and has supplied services as an expert witness. He is recognized by LEXPERT as a leading practitioner in two fields of practice: commercial insurance litigation and transportation. His peers have selected him for inclusion in The Best Lawyers in Canada. John joined Genest Murray LLP as counsel in 2009.

PUBLICATIONS & PRESENTATIONS:
  • John has been a speaker or panellist for various organizations including the Canadian Bar Association, The Canadian Institute, The Ontario Insurance Adjusters' Association and the Ontario Trucking Association and various client-arranged continuing education seminars.
  • John is the author of Motor Carrier Cargo Claims (Carswell's 1986), now in its 5th edition (Nov. 2007), the only Canadian text on road transportation cargo loss claims, freight charge liability and transportation insurance.
  • John has published for peer review in the Advocates' Quarterly ("Employment Disability Schemes: Tarailo v. Allied Chemical", 1992; "The Employer as Protected Defendant, The Legacy of Harrison v. Toronto Motor Car Ltd.", 2003; "Practice and Procedure: Case Management" (with E. Maroudas), 2005, and "The Enigmatic Exception to the Bar Against Subrogation: s. 275 of the Insurance Act", 2008; and for Without Prejudice, an adjuster's periodical, "Damages Actual Cash Value, and Betterment", 1988 and "The Loss Transfer Primer", Feb. 1996.
